Terms and Conditions of sale
Emilia Telese – Online Artwork Sales
("Artist", "we", "us", "our")

1. Agreement
By purchasing an artwork through this website or other online channel, you (“Buyer”) agree to be bound by these Terms & Conditions. The contract of sale is between the Artist and the Buyer.
2. Artwork & Payment
2.1 The Buyer agrees to purchase the specified artwork at the price shown.
2.2 Payment must be made in full (unless otherwise agreed) before shipment or delivery.
2.3 The currency of sale is [e.g., EUR/ISK/USD] as indicated on the website.
2.4 The artwork remains the property of the Artist until full payment has been received and cleared.
3. Shipping & delivery
3.1 The Artist will arrange shipping/delivery to the address provided by the Buyer.
3.2 Shipping costs, insurance, customs duties (if applicable) and any import/export fees are the responsibility of the Buyer unless otherwise stated.
3.3 Delivery dates given are estimates; the Artist is not liable for delays beyond our reasonable control (e.g., customs, carrier delays, force majeure).
4. Returns & Cancellations
4.1 Each artwork is unique; unless explicitly stated otherwise, refunds are not available after shipment.
4.2 If the artwork arrives damaged, the Buyer must notify the Artist within [e.g., 7 days] of receipt, provide photographs of the damage, and retain the original packaging. The Artist will examine the case and may arrange repair, replacement or refund at our discretion.
4.3 Cancellation before dispatch may be agreed at the Artist’s discretion, but a cancellation fee may apply.
5. Intellectual Property & Usage
5.1 The Artist retains copyright and all intellectual property rights in the artwork and any associated images, descriptions, sketches or documentation.
5.2 The Buyer is granted only ownership of the physical artwork and no rights for reproduction, licensing or commercial use unless otherwise agreed in writing.
5.3 Any reproduction, public display, digital usage or resale of the work must credit the Artist and may require additional permission.
6. VAT, Tax & Pricing
6.1 The sale price excludes any applicable shipping, insurance or import/export duties unless otherwise stated.
6.2 Under Icelandic law, works of art sold directly by the artist that fall under customs tariff numbers 9701.1000 – 9703.0000 are exempt from Value Added Tax (VAT) when sold by the artist.
6.3 If you as the Buyer are in Iceland, we will apply the appropriate VAT exemption to your invoice and issue a valid VAT-free invoice in accordance with Icelandic VAT Act.
6.4 If you are a Buyer outside Iceland, you may be responsible for VAT, customs duties or other import taxes in your jurisdiction.
6.5 Each Buyer is responsible for checking the applicable tax rules in the Buyer’s country of residence.
7. Export & Import
7.1 Buyers outside Iceland are responsible for complying with all export requirements from Iceland and import requirements in their country of residence.
7.2 The Artist will provide export documentation as required (e.g., customs declarations, export invoice) but cannot be held liable for customs delays or additional charges.
7.3 In the case of export, the sale may qualify as “zero-rated” for Icelandic VAT if conditions for export are satisfied.
8. Warranty & Liability
8.1 The Artist warrants that the artwork is original and delivered free of any undisclosed third-party claims.
8.2 Except for liability for death or personal injury caused by negligence, the Artist’s total liability under or in connection with these Terms shall not exceed the price paid by the Buyer.
8.3 The Artist shall not be liable for indirect or consequential losses.
9. Governing Law & Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with Icelandic law. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Icelandic courts.
10. Privacy & Data Protection
10.1 We will collect and process your personal data (name, address, payment information) for the purpose of fulfilling the sale, shipping the artwork and accounting.
10.2 We will retain customer data for the period required by Icelandic accounting law.
10.3 We do not share your personal details with third parties except for shipping carriers or required tax/ customs authorities and only under confidentiality.
10.4 By placing an order you consent to this processing in accordance with our Privacy Policy.
11. Amendments
The Artist reserves the right to amend these Terms & Conditions without prior notice. The version published on the website at the time of your order shall apply.
Important Note on VAT Exemption in Iceland
According to the Icelandic Value Added Tax Act, the sale of original works of art by the artist themselves, classified under customs tariff numbers 9701.1000–9703.0000, are exempt from VAT when sold directly by the artist. When buying from this site, you are buying directly from the artist, Emilia Telese, therefore you will not be charged VAT.
