Returns & Cancellation Policy
(in accordance with Icelandic and EEA consumer law)
1. Right of Withdrawal (Cooling-Off Period)
As a consumer residing in the European Economic Area (EEA), you have the legal right to withdraw from your online purchase within 14 days from the day you receive the artwork — without giving any reason.
To exercise this right, you must notify me, Emilia Telese, in writing within the 14-day period. You can do so by email to emiliatelese@emiliatelese.com, clearly stating:
- your name,
- address,
- order details,
- the title of the artwork, and
- a statement that you wish to withdraw from the purchase.
You may use a standard withdrawal form if preferred, but it is not required.
2. Exemptions
The right to withdraw does not apply to:
- Commissions or bespoke artworks created specifically to your order or customised according to your instructions.
- Digital downloads (if applicable) once access has been granted.
- Artwork damaged or altered by the buyer after receipt.
In such cases, sales are final once confirmed and payment has been received.
3. Returns Procedure
If you cancel within the 14-day period, please follow these steps:
- Contact me first at emiliatelese@emiliatelese.com to confirm the return.
- Repack the artwork carefully in its original packaging, including any certificates or documentation.
- Return it to the address provided in the email response.
- You must return the artwork within 14 days of notifying me of your decision to withdraw.
You will be responsible for paying the return shipping costs, unless the artwork arrived damaged or incorrect.
Please use a trackable and insured courier; I cannot accept responsibility for lost or damaged returns.
4. Refunds
Once I have received the artwork in its original condition, I will issue a full refund of the purchase price (including the original standard shipping cost, but excluding any express delivery upgrades).
Refunds are made using the same payment method used for the original purchase, within 14 days of receiving the returned artwork or evidence that it has been sent back.
If the returned artwork is damaged or shows signs of handling beyond what is necessary to inspect it (similar to how you would handle it in a gallery), a deduction may be made to reflect the loss in value.
5. Damaged or Faulty Items
If the artwork arrives damaged, please contact me within 7 days of delivery, attaching clear photographs of the damage and packaging.
I will arrange repair, replacement, or refund depending on the circumstances.
6. Business-to-Business Sales
These consumer protections apply only to private individuals.
Sales to galleries, institutions, or companies are governed by mutually agreed contract terms and are not subject to the 14-day right of withdrawal.
